(1) Unless otherwise agreed between the originator and the recipient, transmission of such electronic record shall be deemed to have taken place after any electronic record enters the information system beyond the control of the originator.
(2) Unless otherwise agreed between the originator and the recipient, the time of receipt of any electronic record shall be determined as prescribed.
(3) Unless otherwise agreed between the originator and the recipient, any electronic record shall be deemed to be transmitted from the originator's place of business and received at the recipient's place of business. Explanation: For the purpose of this sub-section, “place of business” means,-
(a) In the event that the originator or receiver has more than one place of business operation, the place of business operation related to the relevant transaction shall be considered as the place of business operation.
(b) In the event that the originator or recipient does not have a place of business operation, the place of his residence shall be considered as the place of business operation.
